Apple appeals against Epic Games | Pocket Gamer.biz

Apple has appealed the Epic Games case, requesting the suspension of the injunction that allows developers to add in-app links to payment websites.

This emerges from company representatives and documents submitted on Friday.

If Apple wins the stay – to be ruled by a judge in November – a change in rules that allow developers to bypass App Store fees may not take effect until appeals on the case are closed. This process can take years.

Federal judge Yvonne Gonzalez Rogers ruled in nine out of ten cases in antitrust proceedings initiated by Epic in September in favor of Apple.

The judge also ordered Epic Games to pay Apple damages. Epic Games appealed in September, and an Epic Games representative declined to comment.

However, Apple has been instructed to make a fundamental change to its store that will allow mobile apps to direct consumers to external payment methods, offering a potential method of bypassing Apple’s App Store fees.

This temporary injunction is currently scheduled to come into force on December 9, 2021. Apple has yet to publicly explain how App Store policies would change under the regulation, but developers have started developing software based on their interpretation of the ruling.

“At a high level, I believe that without thoughtful restrictions to protect consumers, developers and the iOS platform, this change will harm users, developers and the iOS platform in general,” Trystan Kosmynka, Senior Director App. at Apple review said.

Apple officials have said Apple may be able to change its App Store policies and open discussions with the judge, eliminating the need for an injunction.

Take small bites

Apple made several small concessions to critics of its app distribution rules in response to lawsuits and regulatory attention over the past year to limit major changes to its app store.

It has claimed that it should be able to decide what software can be used on iPhones in order to provide a “better user experience”.

Apple cited some concessions it made under a separate deal with small developers in August in a filing that outlined the reasons for staying.

“The requested suspension will allow Apple to keep consumers safe and secure its platform as the company addresses the complex and rapidly evolving legal, technological and economic issues that any revision of this policy would create,” said Apple- Lawyers in a court file.

Ultimately, should app makers be able to bill their own customers directly without using Apple’s in-app purchase system, it would put the company’s bottom line at risk.

The App Store is part of the company’s services business, which had fiscal 2020 revenue of $ 53.8 billion on a gross margin of 66%, accounting for about 20% of Apple’s revenue.
